The United States District Court for the Eastern District of Oklahoma (in case citations, E.D. Okla. or E.D.Ok.) is the Federal district court whose jurisdiction comprises the following counties: Adair, Atoka, Bryan, Carter, Cherokee, Choctaw, Coal, Haskell, Hughes, Johnston, Latimer, Le Flore, Love, Marshall, McCurtain, McIntosh, Murray, Muskogee, Okfuskee, Okmulgee, Pittsburg, Pontotoc, Pushmataha, Seminole, Sequoyah, and Wagoner. It is based in Muskogee.

Appeals from the Eastern District of Oklahoma are taken to the United States Court of Appeals for the Tenth Circuit (except for patent claims and claims against the U.S. government under the Tucker Act, which are appealed to the Federal Circuit). The court is housed in the Ed Edmondson U.S. Courthouse in Muskogee, Oklahoma.

History

Judge Frank Howell Seay, appointed to the court by President Jimmy Carter in 1979, was the first Native American (Seminole) appointed to any U.S. district court.

US Attorney

The United States Attorney's Office of the Eastern District of Oklahoma represents the United States in civil and criminal litigation in the court. The current United States Attorney for the district is Mark F. Green, who succeeded Sheldon J. Sperling.

On Wednesday, July 14, 2010, a news release from the White House Press Office stated that President Barack Obama had nominated Mark F. Green to be the new United States Attorney. He is the sole practitioner at Mark Green, Attorney, which he opened in 1991. He has also served as an Alternate Judge to the City of Muskogee since 2006 and as a Public Defender in this court since 1990. He has also worked with the Bureau of Indian Affairs and as an Assistant U.S. Attorney. Mr. Green graduated from the University of Oklahoma in 1975 and from the College of Law there in 1978. His nomination must be confirmed by the U.S. Senate.
